These Terms and Conditions ("Terms") govern your use of the VisualSupport mobile app and the VisualSupport platform (together, the "Service"), provided by SRM Systems, LLC ("SRM Systems", "we", "us", or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

VisualSupport is a remote support tool. A support technician or their organization ("Technician") starts a session and provides you a session code or QR code. When you enter it, you can share your live screen, a photo, or a file with the Technician so they can assist you. You choose what to share and can stop at any time.

2. Eligibility

You must be able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

3. Accounts

Technicians must create an account to use certain features. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Joining and sharing in a session

• Only join a session and share content with a Technician you know and trust. A session code lets whoever holds it view what you choose to share during that session.
• You are responsible for the content you choose to share, including your screen, photos, and files. Do not share content you are not permitted to share, and be mindful of sensitive information visible on your screen.
• By starting screen sharing or sending a photo or file, you consent to that content being transmitted to the Technician and their organization.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, deceptive, or abusive purpose.
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
• Use the Service to access, view, or control a device without proper authorization from the person responsible for it.

6. Intellectual property

The Service, including its software, design, and branding, is owned by SRM Systems and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as intended. These Terms do not grant you any rights in our trademarks or content except as needed to use the Service.

7. Third-party services

The Service may rely on third-party platforms and app stores. Your use of those services is subject to their own terms, and we are not responsible for them.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle information.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure, or that any defect will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, SRM Systems and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or profits, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars.

11. Indemnification

You agree to indemnify and hold harmless SRM Systems and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the state in which SRM Systems, LLC is organized, without regard to its conflict of law principles. You agree that any dispute will be resolved in the courts located in that state, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after an update means you accept the revised Terms.
